Preamble
The website bridge-training.com, including all its subdomains, notably app.bridge-training.com, as well as any current or future application interface, web or mobile application operated by Bridge for Good SAS (hereinafter the "Site"), has as its main purpose the creation, sharing, distribution and use of educational content relating to the game of bridge.
The Site is primarily a content sharing platform. It may incidentally be used for managing non-shared or restrictively shared content, without this use constituting the main purpose or encouraged use of the Site.
Access to the Site is in principle free for Users. Its operation is financed notably by the distribution of advertising content and voluntary donations. The Publisher reserves the right to change the financing methods of the Site at any time.
Any use of the Site implies full and complete acceptance of these Terms of Use, as well as the Legal Notice and the Privacy Policy.
Article 1 – Definitions
- Publisher: Bridge for Good SAS.
- Site: the domain name bridge-training.com and all its subdomains, interfaces and associated applications.
- User: any person accessing the Site, with or without an account.
- Subscriber: any User with an active account on the Site.
- Author: any User or Subscriber creating, importing or modifying Content.
- Content: any bridge deal, quiz, text, educational commentary, illustration, configuration or associated element published on the Site.
Article 2 – Access to the Site and Services
The Site includes:
- a public section, accessible without creating an account;
- a section accessible after login, offering advanced features, possibly subject to subscription.
The Publisher reserves the right to suspend, limit or interrupt access to the Site, in whole or in part, without notice or compensation, for any technical, legal, functional or security reason.
The Publisher reserves the right to suspend or terminate, at its sole discretion, a Subscriber's access to the Site at any time, without prior notice or obligation to justify.
Article 3 – Advertising and Blocking Tools
As the Site is financed notably by the distribution of advertising content, the User is informed that the use of software, extensions, scripts or ad-blocking devices, or any other mechanism aimed at preventing the display of advertising content, may alter, degrade or prevent the normal functioning of all or part of the Site.
Consequently, the Publisher does not guarantee access, availability or proper functioning of the Site when such devices are used, and reserves the right to restrict or suspend access to services as long as these devices are active.
Article 4 – Nature of the Service and Role of the Publisher
The Site acts exclusively as a technical platform for hosting, distributing and making content available.
The Publisher:
- is not the author of Content published by Users;
- exercises no prior editorial control;
- assumes no educational, scientific or pedagogical responsibility.
Content is published under the sole responsibility of its Authors.
Article 5 – Intellectual Property of the Site
The Site, its structure, features, code, databases and design are protected by intellectual property law and remain the exclusive property of the Publisher.
Any unauthorized reproduction or exploitation is prohibited.
Article 6 – Author Commitments and Warranties
Every Author expressly undertakes to:
- Hold all necessary rights to the Content they publish or have valid authorization.
- Only publish Content strictly related to the game of bridge, for educational or analytical purposes.
- Refrain from any Content that is:
- illegal, defamatory, insulting, shocking or discriminatory;
- of a political, religious, ideological or activist nature;
- likely to engage the legal liability of the Publisher.
The Author remains solely responsible for the Content they publish.
Article 7 – Content Modification
Textual Content published on the Site may only be modified by:
- its Author;
- or by the Publisher, notably for technical, legal, editorial reasons or compliance with these Terms.
Article 8 – License Applicable to Content
By publishing Content on the Site, the Author declares that such Content is made available under the Creative Commons CC0 1.0 Universal license.
The Author warrants that they hold all rights necessary to place the Content under this license.
To the fullest extent permitted by law, the Author waives all economic rights in the Content and authorizes any person to copy, reproduce, modify, adapt, translate, redistribute, publish, exploit and use the Content freely, for commercial or non-commercial purposes, on any medium and for any purpose, without prior authorization.
This license is worldwide, free of charge, irrevocable and valid for the entire legal term of protection applicable to the Content.
The Author also authorizes the Publisher to host, store, reproduce, modify, translate, analyze, distribute and exploit the Content for the purposes of operating, developing, promoting and running the Site.
Article 9 – Visibility and Accessibility of Content
The Author may assign one of the following statuses to each Content item:
- Private: the Content is visible only to its Author.
- Shared: the Content is visible to the Users designated by the Author through the functionalities provided by the Site.
- Public: the Content is visible to all Users.
These statuses solely determine how Content is displayed and made accessible within the Site.
The Publisher does not guarantee either the confidentiality of Content or the absence of access to or distribution of Content by third parties, regardless of the status selected by the Author.
The Publisher may modify at any time the technical methods used to access, share, index, search, or display Content.
Article 10 – Content Retention and Link Permanence
The Publisher does not guarantee the permanence of URLs, sharing links or Content. Content may be modified, moved, made inaccessible or deleted without notice.
Content declared public or shared may be retained indefinitely, including after the deletion or inactivity of the Author's account.
Article 11 – Reporting and Removal
Any report must be sent to contact@bridge-training.com and include:
- the code of the deal or Content concerned;
- proof of the original source (scan, excerpt, precise reference);
- the detailed reason for the report.
Any incomplete report may be ignored.
The Publisher reserves the right, at its sole discretion, to make the Content private, modify it or delete it.
Article 12 – Liability
The Publisher disclaims all liability regarding:
- the use of Content;
- its accuracy or educational relevance;
- direct or indirect damages related to the use of the Site;
- malfunctions related to the use of blocking devices.
Article 13 – Modification of Terms
The Publisher reserves the right to modify these Terms at any time. The applicable version is the one in force when using the Site.
Article 14 – Authoritative Language
These Terms and Conditions may be made available in multiple languages in order to facilitate their understanding by Users.
The version drafted in the French language shall constitute the authoritative version and shall prevail for the interpretation, performance and application of these Terms and Conditions.
Translations into other languages are provided solely as a courtesy and for informational purposes.
In the event of any contradiction, discrepancy in interpretation, or inconsistency between the French version and any translated version, the French version shall prevail.
Article 15 – Applicable Law and Jurisdiction
These Terms are governed by French law.
Any dispute falls under the exclusive jurisdiction of the Paris courts.
